Terms of service

These Terms of Service ("Terms") govern your use of Before 8am (the "Service"). By accessing or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Before 8am aggregates and curates full-time, contract, freelance, consulting, interim, and fractional opportunities. All listings link to the original employer or authorized provider. Before 8am is not an employer, agency, or party to any employment or engagement between you and a listed organization, and does not guarantee availability, accuracy, or hiring outcomes.

2. Eligibility & accounts

You must be at least 16 years old (or the age of digital consent in your jurisdiction) to create an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us promptly of any unauthorized use.

3. Fair use and limits

Anonymous visitors may open up to 3 opportunity listings. Registered Free members may take up to 5 combined opens/clicks in any rolling 7-day period. Pro members receive unlimited opens, clicks, saves, and alerts. We may adjust limits or throttle usage to prevent abuse.

4. Pro subscriptions

Pro is offered at $6.99/month or $69.99/year (plus applicable taxes), billed in advance via Stripe. Subscriptions renew automatically until canceled. You may cancel at any time from your billing page; cancellation takes effect at the end of the current billing period. Except where required by law, subscription fees are non-refundable. We may change prices with prior notice; changes apply to renewals after the notice period.

5. Employer listings

Employer listings are $99 per listing, billed one time, and remain live for 30 days from publication. Employers are solely responsible for the accuracy, legality, and non-discrimination of listing content and for their hiring decisions. By submitting a listing you warrant that you have authority to post it and that it complies with all applicable laws, including equal-opportunity and anti-discrimination laws. Employer listing fees are non-refundable once the listing has been published, except where required by law. We may reject, edit, or remove any listing at our discretion, including for duplication, low quality, misleading content, or Terms violations; in such cases we may, but are not required to, issue a pro-rata refund for the unpublished portion.

6. Acceptable use

You agree not to:

• Post or distribute unlawful, deceptive, discriminatory, harassing, or infringing content;
• Post multi-level marketing, adult, illegal, unpaid-labor, or "pay-to-work" opportunities;
• Scrape, crawl, or bulk-download listings; use bots or automated means without written permission;
• Circumvent fair-use limits, authentication, or paywalls;
• Impersonate any person or misrepresent an affiliation;
• Introduce malware or attempt to disrupt the Service.

7. Content and license

You retain ownership of content you submit (including employer listings and profile data). You grant Before 8am a worldwide, non-exclusive, royalty-free license to host, display, index, and distribute your content as needed to operate and promote the Service. You represent that you have all rights necessary to grant this license.

8. Copyright / DMCA

If you believe content on the Service infringes your copyright, send a notice to legal@before8am.com including: (i) your signature; (ii) identification of the copyrighted work; (iii) the URL of the infringing material; (iv) your contact information; (v) a statement of good-faith belief that the use is unauthorized; and (vi) a statement, under penalty of perjury, that the notice is accurate and you are authorized to act. We will respond in accordance with applicable law and may remove content and terminate repeat infringers.

9. Third-party sites

Opportunities link to third-party sites. We do not endorse and are not responsible for third-party content, products, or practices. Your interactions with third parties are solely between you and them.

10. Termination

You may close your account at any time. We may suspend or terminate access if you violate these Terms or pose a risk to the Service or others. Sections that by their nature should survive (e.g., ownership, disclaimers, limitation of liability, indemnity, dispute resolution) survive termination.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OPERATION. WE DO NOT WARRANT THAT LISTINGS ARE ACCURATE OR THAT USE OF THE SERVICE WILL RESULT IN AN OFFER, ENGAGEMENT, OR HIRE.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BEFORE 8AM AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR OPPORTUNITIES. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR (B) US $100.

13. Indemnity

You agree to indemnify and hold harmless Before 8am from claims, damages, and expenses (including reasonable attorneys' fees) arising out of your content, your use of the Service, or your violation of these Terms or applicable law.

14. Governing law & disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules. Disputes will be resolved exclusively in the state or federal courts located in Delaware, and you consent to their jurisdiction. Where required by local law, you retain the right to bring claims in your place of residence.

15. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced in-app or by email at least 14 days before taking effect. Continued use after the effective date constitutes acceptance.
